Terms and Conditions for Ishtai

Welcome to Ishtai! These Terms and Conditions ("Terms") govern your access to and use of the Ishtai mobile application ("App") and related services provided by Ishtai ("we," "us," or "our").

By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the App.

1. Eligibility

You must be at least 18 years old to create an account and use the Ishtai App. By using the App, you represent and warrant that you are at least 18 years old and legally capable of entering into a binding contract.

Ishtai is primarily designed for immigrants located in Canada seeking long-lasting relationships. By using the App, you affirm that you meet these criteria.

2. Account Registration and Security

• You must provide accurate and complete information during registration, including your **name, age, qualification, email, and phone number.**
• You are responsible for maintaining the confidentiality of your account login credentials and are solely responsible for all activities that occur under your account.
• You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
• We reserve the right to suspend or terminate your account if any information provided is found to be inaccurate, incomplete, or violates these Terms.
• **Verification:** We may require **phone verification (via SMS)** and **ID verification** to ensure the authenticity and safety of our community. Failure to complete verification may result in account suspension or termination.

3. User Conduct and Responsibilities

You agree to use the App responsibly and ethically. You must not:

• **Misrepresent yourself:** Provide false information, use fake identities, or impersonate any person or entity.
• **Post inappropriate content:** Upload or share any content that is offensive, defamatory, obscene, sexually explicit, abusive, hateful, discriminatory, or promotes violence.
• **Harass or abuse others:** Engage in any form of harassment, stalking, bullying, or abusive behavior towards other users.
• **Violate privacy:** Attempt to obtain personal information about other users without their consent or share their private information.
• **Engage in commercial activities:** Use the App for any commercial purposes, advertising, solicitation, or spamming.
• **Circumvent security:** Attempt to interfere with, disrupt, or bypass any security features of the App.
• **Infringe intellectual property:** Post content that infringes on the intellectual property rights of others.
• **Violate laws:** Use the App for any illegal activities or in violation of any applicable local, provincial, federal, or international laws.

We reserve the right to remove any content that violates these Terms and to suspend or terminate accounts of users who engage in such conduct.

4. Content You Provide

• You retain all ownership rights to the content you upload or submit to the App, including **images** and **chat messages**.
• By uploading content, you grant Ishtai a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and display such content in connection with the operation of the App and our business, including for promotional purposes.
• You acknowledge that other users may be able to view, access, and share your public profile content.

5. Matching and Communication

• The App's matching algorithm is based on the preferences you provide and other data to suggest compatible individuals. We do not guarantee a match or the success of any relationship initiated through the App.
• **Chat functionality** is provided for matched users to communicate. All chat communications are subject to these Terms and our Privacy Policy.

6. Location Permission

The App requests **location permission** to help you find matches based on proximity and to verify your presence in Canada. You can disable this permission in your device settings, but it may affect your ability to use certain features.

7. Third-Party Links and Services

The App may contain links to third-party websites or services that are not owned or controlled by Ishtai. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. We encourage you to read the terms and privacy policies of any third-party websites or services that you visit.

8. Disclaimers and Limitation of Liability

• The App is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, regarding the App's operation or the information, content, materials, or products included on the App.
• Ishtai is not responsible for the conduct, online or offline, of any user of the App. You are solely responsible for your interactions with other users.
• In no event shall Ishtai, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the App; (ii) any conduct or content of any third party on the App; (iii) any content obtained from the App; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of [Your Jurisdiction in Canada, e.g., Ontario], without regard to its conflict of law provisions.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time.
